Creating Value from Bio‐resources: Understanding and Navigating the National Biodiversity Act

This talk will focus on providing an overview of the regulatory regime under the Biological Diversity Act, 2002 and the Rules framed there under. Talk will look at the important provisions and approval requirements under the statute and most importantly understand the scope and ambit of this statute. It will have specific discuss about the approval process for bioresearches used in patent applications. This is a confluence of Patent law and Biodiversity Act and
stakeholders need to navigate this to get approval before the grant of the patent. Another aspect that will be discussed is the exemption for food crops under ITPGR&FA. The talk will also peruse the roles and responsibilities of the National Biodiversity Authority and the State Biodiversity Authorities as provided under the statute. Finally, there will be a discussion on Access and Benefit Sharing aspect as encompassed by this statute and the Guidelines issued in respect of the same.
